General terms of business :

1. Validity of the conditions
The offer of the Heunec & Co. KG (in the following Heunec) encloses goods achievements. Our deliveries and offers occur exclusively on account of these terms of business other details arise from to the buyer with the order to transmitted purchase information. These are valid therefore also for all future business relations, even if you not expressly agreed once again. At the latest with acceptance of the product these conditions are valid as accepted. Herewith counterconfirmations of the contracting partner with reference to his business or shopping terms become disagreed.

2. Data protection
To guarantee a perfect and quick order treatment HEUNEC stores your data in the EDP.
The contact with your data occurs without exception according to the regulations of the German data protection right.
Their data are used only for the order winding up and, in addition, aren´t transmitted to third parts.

3. Terms of utilisation
Heunec only sells to

1. people that have completed their 18th year and are unrestrictedly contractually capable.

2. legal entities

The data needed for the registration or order, like name, address, age etc. are entire and true to brag. The use of the Heunec shop is free. With an order the costs performed on offer in each case result for purchase price and delivery incurred. The prices of the day of the order are valid. They are called again in the terms of business.
All prices get on incl. value added tax.

4. Contract formation
HEUNEC confirms the order by email, therefore the bill of sale comes about. With telephone order the bill of sale comes about by the verbal confirmation by a HEUNEC - employee, by the delivery of the ordered goods.
Should a product not be available, conditioned by too high inquiry, so HEUNEC is entitled to withdraw from the bill of sale.

5. Right of return
The customer is entitled to return the ordered product without giving reasons, within a term of two weeks on receipt, to HEUNEC. This assumes the sending appropriate for term of the product. The date of the postmark counts. In case of the return HEUNEC bears the costs for the return, unless the goods value lies less than 25.56 euros. You find the detailed winding up of the Retoure under point 9 "Redelivery" in this AGB's.
The state of the product must be flawless, so that a "resale ability" is guaranteed. With recognizable use tracks the depreciation of the customer is to be substituted.

6. Delivery and forwarding expenses
The delivery occurs in given address of delivery. The attacking forwarding expenses and the dispatch kind (post) are performed in each case with the terms of delivery for the offered products as well as in the email confirmation of the order.
Our forwarding expenses amount on inclusively 5. - Euro with postal cash on delivery and 3 euro on credit card payment. The costs contain the Handling, the packaging, carriage costs as well as the COD charge. The additional COD charges of the German post go to loads of the customer.
At the moment these fees amount with the post 2. - Euro and are raised with the delivery.

7. Payment and retention of title
The cash on delivery becomes due immediately with the delivery and is to be handed over to the respective forwarding agent (German post) directly. The product ordered by you remains our property up to the entire payment.

8. Guarantee and guarantee
The buyer has to check the delivered product with entrance immediately on defects considering the examine state and intended purpose, otherwise the product is valid as approved. Objections are only considered if you report recognizable defects within eight days after receiving the product, with concealed defects within eight days after your discovery, in writing under attachment of evidence.

With omission of this term guarantee rights are excluded because of an evident lack. Our guarantee obligation limits itself after our choice to substitute delivery, change, decrease or finishing touches. Guarantee claims are entitled only to the immediate contracting partner and are not transferable.

9. Retoure
Please contact us before possibly returning our products (contacts called in point 8), in guarantee cases please be holding the document number of the calculation ready. We will help you with pleasure. The following conditions to the Retoure must be considered:

Attaching copie of the document

Note the name of the HEUNEC employee that agreed with you regarding the Retoure.

Disregard of this default which leads damages or delays with itself go to loads of the customer. HEUNEC is entitled to require a cost-all-inclusive at the rate of 10% of the purchase price, at least, 10.23 euros if a product is sent back, without a right of return is given after figure 5 of the Terms and Conditions, or

no guarantee or guarantee case is given
(Figure 8 and 9 of the Terms and Conditions)

The proof of higher or low costs is left to the customer as well as HEUNEC.

10. Compensation
A compensation claim against us for any legal argument is excluded. This is not valid, as far as we stick according to compelling legal regulations because of intention or coarse carelessness unrestrictedly.
HEUNEC assumes no liability for

the constant and uninterrupted availability
of the online shop www.heunec soft shop.de

and for technical or electronic mistakes of online offers

 

12. Ending of the contract / offence against the Terms and Conditions
With behaviour contrary to the terms of the agreement of the contracting partner against these AGB's customers can be excluded without advance advice from the other participation.

13. Change of the general terms of business
These AGB's can be changed any time and without giving reasons by HEUNEC.
Effected orders are not influenced by changes. The recognition of the valid Terms and Conditions in each case can be seen by the order.

14. Applicable right, court state, partial gewgaw
The right of the Federal Republic of Germany is valid for these commercial terms and the whole legal respect to the exclusion of the UN-purchase right. If the buyer is an independent commercial agent, the legal venue is Coburg or after our choice his general legal venue. Should a regulation be ineffective in these business relations or a regulation within the scope of other arrangements or become, the effectiveness of all other regulations or arrangements is not touched from this.
